Terms & Conditions

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

Promoter and Data Controller is Holy Moly Ltd, Carina East, Sunrise Parkway, Milton Keynes, MK14 6LS. Please do not send claims to this address.

1. The Holy Moly ‘Tasting is Believing’ promotion is open to UK residents, who are aged 18 years and over and excluding employees (and their families) of Holy Moly Ltd., subsidiary, and associated companies, their agencies, and anyone professionally connected with this promotion.

2. The Holy Moly ‘Tasting is Believing’ promotion applies to promotional packs of:

  • Garlic Aioli 155g
  • Guacamole Original 150g
  • Smashed Avocado 150g
  • Guacamole Jalapeno & Red Pepper 150g
  • Original Hummus 150g
  • Pesto Hummus 150g
  • Harissa Hummus 150g
  • Red Pepper & Tomato Salsa 150g

3. Purchase necessary. Please retain your original itemised till receipt showing the time and date of purchase prior to claim as this will be required for validation. Internet access, email address, and valid bank account or Paypal account are required.

4. Purchase period: To take part in the promotion, purchase a promotional pack of Holy Moly Dips within the promotional period 00:00 15th May 2023 to 23:59 12th May 2024. Claim Period: Claim online at www.tastingisbelieving.co.uk between 00:00 15th May 2023 and 23:59 on 26th May 2024.

5. To claim your money back, purchase a promotional product within the purchase period, and if you are not completely satisfied with the product visit www.tastingisbelieving.co.uk. Complete the online registration form by entering your personal details including full name, full postal address, and a valid email address.

Here you will be able to choose your refund method, either via Paypal or BACS. You will need to provide a minimum of 15 words explaining why you did not like your Holy Moly Dips product and upload a photo of your promotional pack and itemised purchase receipt.

The receipt will need to show purchase of a qualifying Holy Moly Dips pack and must be dated within the promotional period (00:00 15th May 2023 to 23:59 12th May 2024). Till receipts must be uploaded in the format of PNG, GIF, or JPEG and a maximum file size limit of 3MB applies. Please keep your original itemised till receipt as it may be required to further verify a claim. Till receipts must not be altered or tampered with.

If you would like to be refunded via bank transfer, you will also need to enter your bank details including sort-code and account number so that we can refund you via BACS once your claim has been verified.

If you opt to receive your money back via Paypal, enter the full name and email address that appears on the Paypal account.

6. Claims must be made by 23:59 26th May 2024. Any claim attempts made after this date or receipts that are not dated within the promotional period, or don’t show purchase of the following: Smoky Garlic Aioli 155g, Tomato & Mango Salsa 155g, Guacamole Original 150 g, Smashed Avocado 150g, Guacamole Jalapeno & Red Pepper 150g, Original Hummus 150g, Pesto Hummus 150g or Harissa Hummus 150g will be deemed as invalid. The promoter has no control over retailer stock cycles and accepts no responsibility for promotional packs purchased after the closing date.

7. Only one claim for a single refund per household, bank account, and email address for the entire claim period. Each person can only claim for one pack, regardless of variety or quantity purchased.

8. Direct claims only, participants cannot make claims under someone else’s name or address. Please ensure you use your legal name at the time of claiming. The Promoter reserves the right to disqualify any Claimant who uses multiple names or any false names and to require them to return to the Promoter any refund awarded.

9. Each valid claim will receive a refund relative to the itemised amount shown on the purchase receipt for the qualifying Holy Moly Dips product purchased and to a maximum value of £3.00. All claimants will receive an email, either confirming validation or rejection with reasons and, where appropriate, the action required to correct.

10. For valid claims, refunds will be provided within 28 days of submission. The Promoter is not responsible for incorrect payments where the details provided were incorrect. Payments cannot be reversed once they have been processed. No replacement payments will be granted. The Promoter is not responsible for system errors or other issues that may result in disruption while the Claimant is on the PayPal platform.

BACS payments will only be made payable to the person whose name appears on the online registration form and the bank details entered. Please ensure your name is typed correctly and matches the name of the account holder.

Paypal payments will only be made payable to the person whose name appears on the online registration form and the email address entered. Please ensure your email is typed correctly and matches the name of the Paypal account holder.

Payments will be administered by Mad About Handling Ltd. The Promoter is not responsible for incorrect payments where the details provided were incorrect. Payments cannot be reversed once they have been processed. No replacement payments will be granted

11. Each purchase receipt can be used only once. If more than the permitted number of claims are received from the same postal address, bank account or email address, all such claims and any associated claims from their household, bank account or email address will be disqualified. Bulk claims made from trade, consumer groups, or third parties will not be accepted.

12. Incomplete or illegible claims, or via third parties or syndicates, claims by macros or other automated means, and claims which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is attempting to circumvent this condition by, for example, using identities other than their own or automated means, their claim will be void.

13. Your statutory rights remain unaffected.

15. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose unless we have your consent. All data will be deleted 2 months after the promotion end date. You acknowledge that the Promoter may pass such information to its third-party agencies, Mad About Handling Ltd & Activation Digital Ltd, solely for the purposes of administering the promotion. 16. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to dpo@weareactivation.com. By participating in the Promotion, you agree to the use of your personal data as described here.

17. The Promoter accepts no responsibility for late, incomplete, incorrectly submitted, corrupted, or misdirected claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure, or otherwise.

18. Where a Claimant (i) has not completed fully; or (ii) has been found to be in breach of any of the terms and conditions of this promotion the Promoter may enforce its right to disqualify that person and require the return or reimbursement to us of any refund even where a refund has already been awarded and/or actually provided to the Claimant or awarded to the Claimant in question.

19. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion modify or suspend the competition or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

20. English law shall govern these terms and conditions and the courts of England and Wales shall have exclusive jurisdiction.

21. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these terms and conditions, and the remaining clauses shall survive and remain in full force and effect.
